Is Purchasing Delta 8 CBD Illegal in Colorado?

You’re probably already aware that Colorado was one of the first states in the US to legalize recreational and medical marijuana. Since then, the state has been known for lax attitudes toward cannabis products. That’s why it might surprise you to learn that buying Delta 8 CBD is not legal in Colorado.

Under current Colorado law, in-store CBD dispensaries and online vendors in Colorado are not permitted to stock or sell any delta-8 products. This may change in the future but as the law stands, these products are not legal in the state.

So why is this?

Back in May 2021, the Marijuana Enforcement Division (MED) alerted dispensaries in Colorado that “Industrial Hemp Product is not permitted to be further processed or extracted.” The reasoning given for this declaration is an objection to the extraction process for extracting delta 8 and other cannabinoids like delta 9 and delta 10 THC.

If you’re a frequent user of delta 8 and plan to travel to Colorado soon, it might be a good idea to leave your delta 8 products at home. Not only is producing and selling these products illegal in Colorado, using and consuming them is too. In the event that you got caught by law enforcement with delta 8 products in your possession in Colorado, you could face a fine for carrying them.
